By downloading, installing, or using Nagi.Timer ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

Nagi.Timer is a local-first focus timer application for iOS. The app provides Pomodoro-style timer functionality with session tracking, tagging, and optional premium features. All user data is stored locally on the device.

4. Free and Premium Features

Nagi.Timer offers both free and premium functionality:

Free Features

• Timer with three built-in presets (Work, Flow, Research)
• Automatic break cycling
• Session logging with default tags
• Today's session history
• Light and dark mode
• Notification sounds and haptic feedback

Premium Features

• Custom timer durations
• Custom tags with color selection
• Weekly summary and insights
• Tag breakdown analytics
• Calendar heatmap

Premium features require an active subscription or lifetime purchase. We reserve the right to modify which features are included in free and premium tiers with reasonable notice.

5. Subscriptions and Payments

Pricing

Premium access is available through the following options:

• Monthly subscription: €0.99/month
• Yearly subscription: €4.99/year
• Lifetime access: €14.99 one-time purchase

Prices are inclusive of applicable taxes and may vary by region based on App Store pricing. We reserve the right to adjust pricing with reasonable notice.

Payment Processing

All payments are processed through Apple's App Store. By making a purchase, you also agree to Apple's Terms and Conditions. Subscription management is facilitated by RevenueCat, Inc.

Subscription Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription at any time through your Apple ID account settings.

Upon cancellation, you retain access to premium features until the end of the current billing period. After that, premium features will no longer be available, but your locally stored data remains on your device.

Refunds

Refunds are handled by Apple in accordance with their refund policies. To request a refund, visit reportaproblem.apple.com.

6. User Data and Privacy

Nagi.Timer is a local-first application. Your timer sessions, tags, and preferences are stored exclusively on your device. The app collects anonymous product analytics to improve the service; see our Privacy Policy for details.

Any emails sent to us for support or feedback are deleted once the inquiry is resolved. We do not retain feedback email data long-term.

You are solely responsible for backing up your device. If you delete the app or lose your device, locally stored data cannot be recovered by us.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the app
• Modify, adapt, or create derivative works based on the app
• Distribute, license, sell, or transfer the app outside of the App Store
• Use the app for any unlawful purpose
• Circumvent or attempt to circumvent any access restrictions or premium feature limitations

8. Intellectual Property

All content, design, code, graphics, and other materials in Nagi.Timer are owned by or licensed to the service provider and are protected by applicable intellectual property laws. The Nagi.Timer name, logo, and visual identity (including the dot grid design) are proprietary.

Your purchase grants you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes on devices you own or control, in accordance with Apple's App Store terms.

9. Disclaimer of Warranties

Nagi.Timer is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. Timer accuracy depends on device hardware and operating system behavior, which is outside our control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the service provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app.

Our total liability for any claims arising from these Terms or your use of the app shall not exceed the amount you have paid for premium features in the twelve (12) months preceding the claim.

11. Right of Withdrawal

If you are a consumer in the European Economic Area, you have a 14-day right of withdrawal from the date of purchase. However, by downloading and using digital content (the app), you acknowledge that you may lose your right of withdrawal once the download or streaming of the content has begun, in accordance with Article 16(m) of the EU Consumer Rights Directive.

For subscriptions, you may cancel at any time through your Apple ID account settings. Refund requests should be directed to Apple.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the app after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users through the app or other means.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer in the European Union, you also benefit from any mandatory provisions of the consumer protection law in your country of residence.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
